Terms of Use

GayBKK is a digital platform designed to help people discover, explore, and connect with LGBTQ+ communities, people, places, events, travel information, and lifestyle experiences in Bangkok and elsewhere.

Depending on the features available at any particular time, GayBKK may provide:

• User profiles and community features
• Nearby and location-based discovery
• Private messaging and chat
• User-generated photos and other content
• LGBTQ+ venue and business listings
• Bars, clubs, saunas, spas, hotels, restaurants, attractions, and other places
• Events and community information
• Editorial content, guides, and recommendations
• Search and discovery tools
• Reporting, blocking, and safety features
• Other community, travel, lifestyle, or discovery services

GayBKK may add, modify, suspend, or discontinue features from time to time.

You must be at least 18 years old to create an account or use any feature of GayBKK that is intended for adults.

By using GayBKK, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into these Terms.
• The information you provide is accurate to the best of your knowledge.
• You are not prohibited from using the Service under applicable law.
• You will comply with all applicable laws and regulations.

GayBKK is not intended for children. If we reasonably believe that an account belongs to a person under 18, we may suspend or terminate that account and remove associated content.

Certain features require an account. When creating an account, you agree to:

• Provide accurate and reasonably current information.
• Keep your login credentials secure.
• Maintain the confidentiality of your account.
• Not allow another person to use your account.
• Notify us if you believe your account has been compromised.
• Not create an account using another person's identity without authorization.
• Not create multiple accounts for abusive, deceptive, or fraudulent purposes.

You are responsible for activity occurring through your account unless you can demonstrate that the activity occurred without your authorization and despite reasonable security measures.

GayBKK allows users to create profiles containing information such as:

• Display name
• Username
• Profile photo
• Biography
• Interests
• Location or area information
• Other information voluntarily provided by the user

You are responsible for the information and content you choose to publish.

You must not impersonate another person, organization, public figure, business, or GayBKK representative.

You must not create a profile that is misleading, deceptive, fraudulent, or intended to facilitate abuse or harassment.

Users may submit, upload, publish, transmit, or otherwise make available content through GayBKK (“User Content”). User Content may include photos, profile information, text, reviews, comments, messages, recommendations, event information, business information, and other materials submitted through the Service.

You retain ownership of User Content that you lawfully own. However, by submitting User Content to GayBKK, you grant GayBKK a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, format, distribute, and make that content available through the Service as reasonably necessary to operate, maintain, improve, and promote GayBKK.

This license continues for as long as necessary for the purposes described above, subject to applicable law and our Privacy Policy.

You represent that:

• You own or have sufficient rights to submit the content.
• You have obtained necessary permissions from people appearing in the content where required.
• The content does not violate another person's rights.
• The content does not violate applicable law.
• The content does not contain malicious software or harmful code.

GayBKK is a community platform where users may share photographs and other visual content. You must not upload photographs that:

• You do not have permission to use.
• Infringe copyright, trademark, privacy, publicity, or other rights.
• Misrepresent another person.
• Are intended to harass, threaten, shame, or expose another person.
• Contain personal or sensitive information about another person without appropriate authorization.
• Depict minors in sexual or exploitative contexts.
• Contain illegal sexual exploitation or abuse.
• Are otherwise unlawful.

GayBKK may remove, restrict, or disable access to images that violate these Terms or applicable law.

Where GayBKK provides private photo or photo-request functionality, users are responsible for using those features respectfully and lawfully.

You must not:

• Pressure another user to share private photos.
• Threaten or blackmail another user over private content.
• Screenshot, copy, redistribute, sell, or publish private content without authorization.
• Use private content to identify, harass, threaten, or expose another person.
• Attempt to bypass privacy controls.

Receiving access to private content does not transfer ownership or redistribution rights.

GayBKK may provide private messaging, chat, or other communication tools. Users are responsible for their communications.

You must not use messaging features to:

• Harass or threaten another person.
• Send spam or unsolicited commercial messages.
• Scam or defraud users.
• Request or distribute illegal content.
• Engage in extortion or blackmail.
• Distribute malware, phishing links, or malicious code.
• Circumvent blocking or other safety controls.
• Repeatedly contact someone who has asked you to stop.
• Coordinate unlawful activity.

GayBKK may restrict messaging privileges, suspend accounts, or investigate reported communications where reasonably necessary to protect users, comply with law, or enforce these Terms.

GayBKK may provide location-based features, including nearby discovery. Depending on the feature and your permissions, location information may be used to provide relevant discovery results.

Location information displayed to other users may be approximate and should not be assumed to represent your exact physical location. You should not attempt to determine another person's exact location through GayBKK.

You must not use location information obtained through GayBKK to stalk, harass, threaten, or monitor another person's movements without authorization, or to facilitate violence, abuse, or other unlawful activity.

GayBKK may provide tools that allow users to block or report other users or content. You are encouraged to use these tools when you encounter harassment, threats, fraud, spam, impersonation, abusive behavior, suspicious activity, privacy violations, illegal content, or other violations of these Terms.

Reports may be reviewed using automated and/or human processes. Submitting a report does not guarantee that GayBKK will take a particular action. We may take action when we determine that action is appropriate, including removing content, restricting features, suspending accounts, or terminating accounts.

You must not use GayBKK to engage in:

11.1 Illegal Activities

• Violate applicable laws or regulations.
• Facilitate criminal activity.
• Buy, sell, distribute, or promote illegal goods or services.
• Encourage violence or criminal conduct.

11.2 Fraud and Deception

• Scam or defraud users.
• Impersonate another person.
• Use false identities for fraudulent purposes.
• Manipulate users for financial gain.
• Promote fraudulent investment, employment, immigration, travel, or other schemes.

11.3 Harassment and Abuse

• Threaten another person.
• Stalk another person.
• Dox or expose private information.
• Blackmail or extort another person.
• Engage in targeted harassment.
• Circumvent another user's block.

11.4 Sexual Exploitation

GayBKK does not permit sexual exploitation of minors, sexual content involving minors, non-consensual intimate imagery, sexual blackmail, sexual exploitation or trafficking, or content intended to facilitate sexual abuse.

11.5 Spam and Commercial Abuse

• Send bulk unsolicited messages.
• Scrape user information for unauthorized commercial purposes.
• Operate bots that contact users without authorization.
• Promote malicious websites.
• Distribute phishing links.
• Manipulate engagement or ratings.

11.6 Technical Abuse

• Attempt to gain unauthorized access to the Service.
• Circumvent authentication or security mechanisms.
• Probe or attack our infrastructure.
• Introduce malware.
• Reverse engineer the Service except where permitted by applicable law.
• Interfere with the availability or performance of the Service.
• Use automated systems to collect data without authorization.

GayBKK is intended to provide a respectful environment for LGBTQ+ people and allies. We do not tolerate discrimination or harassment based on sexual orientation, gender identity, gender expression, sex, race or ethnicity, nationality, religion, disability, age, or other protected characteristics under applicable law.

Differences in identity, appearance, background, preferences, or lifestyle are not invitations to harass or demean other users.

GayBKK may help users discover and communicate with other people, but GayBKK does not guarantee user identity, profile authenticity, user safety, availability, or suitability.

If you choose to meet someone in person, you do so at your own discretion and risk. We strongly recommend meeting in public places, telling a trusted person where you are going, using your own transportation, avoiding sharing sensitive personal info too quickly, being cautious about financial requests, and leaving immediately if you feel unsafe.

GayBKK may display information about businesses, venues, hotels, spas, saunas, restaurants, events, and other places. Listings may be submitted by users/businesses, obtained from public sources, curated by GayBKK, or assisted through automated systems.

We do not guarantee that listing information is always accurate, complete, current, available, or officially endorsed. Users should verify important information directly with the relevant business.

Where reviews or recommendations are available, they represent the opinions of individual users. GayBKK does not necessarily endorse or agree with user reviews.

Users must not post fake reviews, review a business solely to manipulate its reputation, threaten a business, offer/accept payment for fraudulent reviews, or publish knowingly false statements.

GayBKK may contain links, integrations, advertisements, embedded content, or references to third-party services (authentication providers, maps, social networks, payment providers, booking services, etc.).

GayBKK does not control third-party services and is not responsible for their independent policies, availability, content, security, or practices.

GayBKK may generate revenue through advertising, sponsored placements, affiliate links, business partnerships, or promotional arrangements. Where required, commercial relationships may be identified appropriately.

An affiliate relationship does not necessarily mean that GayBKK guarantees, endorses, or independently verifies the relevant product or service.

The GayBKK Service and its original materials (branding, logos, website design, software, user interface, original graphics, editorial content, text, code) are protected by intellectual property laws.

Except as expressly permitted, you may not copy substantial portions, reproduce branding without permission, sell proprietary materials, reverse engineer software where prohibited, or create a competing service.

If you believe content on GayBKK infringes your copyright, contact us with sufficient information to identify the copyrighted work, allegedly infringing material, location, contact info, and statements of good-faith belief and accuracy.

GayBKK may, but is not required to, monitor or review content and activity. We may remove, restrict, hide, disable, or modify content when it violates these terms, law, safety risks, rights, or integrity of the service.

We may suspend or terminate your account if we reasonably believe you violated these terms, law, safety/security, or engaged in fraud/abuse. You may stop using GayBKK at any time and request account deletion.

After termination, your right to use the Service ends immediately, profile access may be lost, and User Content may no longer be publicly accessible, though some data may remain for legal or security compliance.

We do not guarantee uninterrupted, error-free, or secure service availability. We may suspend or modify the service for maintenance, security, updates, legal requirements, or emergencies.

GayBKK is a discovery and community platform. We do not guarantee identity, conduct, intentions, statements, content, products, services, or behavior of users, businesses, or venues.

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

To the fullest extent permitted by law, GayBKK and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

You are responsible for your own decisions and actions when using GayBKK, communicating with others, sharing personal information or photos, visiting venues, and meeting offline.

You agree to defend, indemnify, and hold harmless GayBKK and its operators from claims, losses, liabilities, and expenses arising from your violation of these terms or misuse of the Service.

Your use of GayBKK is also governed by our Privacy Policy, complying with Thailand's Personal Data Protection Act (PDPA) and other applicable data protection laws.

You agree to receive electronic communications regarding your account and the Service, recognized under Thailand's Electronic Transactions Act.

We may update these Terms from time to time. Continued use of GayBKK after the effective date constitutes your acceptance of the revised Terms.

These Terms shall be governed by and interpreted in accordance with the laws of Thailand. Any dispute shall be subject to the jurisdiction of the competent courts of Thailand.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

These Terms, along with our Privacy Policy, constitute the entire agreement between you and GayBKK concerning your use of the Service.
